در نهمین جلسه دادگاه رسیدگی به پرونده فساد بزرگ مالی ؛ هفت متهم ' ی .م .م ' ، ' ك . ر' ، ' ش . ر . ذ ' ، ' ك . ن . د ' ، ' م .ح ' ، ' ع . ا ' و ' م . ز ' و یك مطلع ' ا . ر .ط ' حضور می یابند.

ماجرای این پرونده 15 هزار صفحه ای كه روز به روز بر تعداد صفحات آن افزوده می شود، به اوایل سال 1380 برمی گردد.

ناسالم بودن فعالیت اقتصادی متهمان این پرونده، زمانی افشا شد كه آنها با انجام معاملات صوری و فاكتورهای جعلی اقدام به دریافت ال سی از یك بانك و تنزیل آن در بانك دیگر می كردند.

این شركت ها، معاملاتی صوری را میان خود انجام می دادند و سپس از بانك می خواستند برای آنها ال سی كه اغلب ال سی های ریالی بود، صادر كند.

'محمد جهرمی' مدیرعامل بانك صادرات استعفا داد و 'محمود رضا خاوری' مدیر عامل بانك ملی نیز از ایران به كانادا گریخت و تاكنون تلاش ها برای بازگرداندن وی به نتیجه ای نرسیده است.

مدیر عامل بانك سامان از دیگر كسانی بود كه رییس بانك مركزی، دستور بركناری او را صادر كرد.

پس از افشای ماجرای این فساد بزرگ مالی، آیت الله صادق آملی لاریجانی رییس قوه قضاییه طی حكمی حجت الاسلام و المسلمین غلامحسین محسنی اژه ای دادستان كل كشور را مسوول نظارت بر رسیدگی به این پرونده كرد.

محسنی ا‍ژه ای نیز قاضی 'ناصر سراج' را به عنوان قاضی این پرونده پر سر و صدا برگزید.

تاكنون هشت جلسه از جلسات دادگاه رسیدگی به پرونده فساد بزرگ مالی در دادگاه انقلاب اسلامی تهران به صورت علنی به ریاست قاضی سراج برگزار شده است.

جلسات دادگاه با صدور كیفرخواست برای 32 تن از متهمان این پرونده آغاز شده است اما به گفته دادستان كل كشور و دادستان تهران، متهمان این پرونده به بیش از 100 نفر خواهند رسید كه با صدور كیفرخواست، آنها نیز باید در دادگاه حاضر شوند.

پنج نفر از متهمان این پرونده بر اساس كیفرخواست صادرشده مصداق ماده یك و دو قانون اخلالگران نظام اقتصادی كشور و نیز ماده چهار قانون تشدید مجازات مرتكبین ارتشاء و اختلاس و كلاهبرداری كه مربوط به مفسدان فی‌الارض هستند، تشخیص داده شده‌اند و درخواست مجازات‌های مربوط در این خصوص شده است.

نخستین جلسه دادگاه به ریاست قاضی سراج، 29 بهمن ماه 1390 در دادگاه انقلاب برگزار شد كه در این جلسه به قرائت كیفرخواست متهم ردیف اول پرداخته شد و سپس متهم و وكیل مدافعش به دفاع از اتهامات پرداختند.

دومین جلسه رسیدگی به پرونده فساد بزرگ مالی صبح یكشنبه، 21 اسفندماه در شعبه اول دادگاه انقلاب برگزار شد.

دراین جلسه، دو متهم – رییس بانك صادرات گروه ملی فولاد و مدیرعامل گروه ملی فولاد – به عنوان مطلع، مطالبی را بیان كردند اما 'م.الف' متهم ردیف اول به دلیل استعفای وكیلش، از بیان دفاعیات خودداری كرد.

بعد از پایان توضیحات و اظهارات دو متهم پرونده در مقام مطلع، 'م.الف' متهم ردیف اول پرونده در جایگاه قرار گرفت و دفاعیاتی را ارائه كرد.

دومین جلسه دادگاه 27 اسفندماه با تفهیم اتهام متهم ردیف دوم آغاز شد و متهم كه مدیر یكی از شعبات بانك صادرات اهواز بود در پاسخ به پرسش قاضی درباره بدون وصول گذاشتن بیست تریلیون ال‌سی و ضربه‌ای كه با وصول آن به نظام اقتصادی كشور وارد می‌شد، گفت: ما قصد ضربه زدن به نظام را نداشتیم.

وكیل مدافع متهم در این باره گفت: گشایش اعتبارات اسنادی توسط متهم، قانونی بوده و او خلافكار نیست؛ هرچند سقف گشایش‌ها را رعایت نكرده است.

در ادامه وكیل متهم برای دفاع در جایگاه قرار گرفت و مدعی شد: هیچ مقام استانی در مورد صوری بودن اسناد پس از دو سال اعتراض نكرد. اعتبارات اسنادی قانونی بوده است ولی روند انجام آن قانونی نیست .

فراهانی، نماینده دادستان تهران در این جلسه گفت: این اظهارات وكیل مدافع متهم ردیف دوم، مغایر با محتویات پرونده است كه حتی متهم نیز از این مغایرت تعجب كرده است.

وی افزود: در این پرونده، 10 نفر از قضات با تجربه و حرفه‌ای دادسرا بر این باورند آقای 'س. ك' مشمول بند اختلال در نظام اقتصادی كشور می‌شود و ال سی، نوع دیگری از اسناد مالی است كه به طور صوری، پولی غیر قانونی را وارد چرخه نظام اقتصادی كرده‌اند. پرسش من این است آیا رشوه كلان كه در قانون آمده است، شامل دو و نیم میلیارد تومان رشوه نمی‌شود؟

غلامعلی ریاحی، وكیل جدید متهم ردیف اول پرونده فساد مالی در این جلسه معرفی شد .

ریاحی گفت كه با پذیرش وكالت متهم ردیف اول پرونده توسط شعبانی - وكیل سابق متهم ردیف اول - موضوع وكالت وی مسكوت ماند اما اكنون با استعفای دومین وكیل و بر پایه خواست متهم ردیف اول اختلاس بزرگ و خانواده او وكالت نامبرده را پذیرفته است.

در چهارمین جلسه دادگاه رسیدگی به پرونده فساد بزرگ مالی كه به صورت علنی و با حضور خبرنگاران رسانه ها برگزار شده بود، علاوه بر نماینده دادستان تهران، نماینده و وكلای مدافع بانك صادرات نیز حضور داشتند.

در این جلسه به اتهامات'ب.ب' از متهمان ردیف دوم پرونده فساد بزرگ مالی رسیدگی شد.

نماینده دادستان در چهارمین جلسه رسیدگی به پرونده فساد بزرگ مالی، متن كیفرخواست این متهم را قرائت كرد و او به همراه وكیلش به دفاع از خود پرداخت.

ششمین جلسه دادگاه فساد بزرگ مالی با تفیهم اتهام 'الف – ش' معاون سرمایه گذاری شركت سرمایه گذاری آریا و به ریاست قاضی سراج به صورت علنی برگزار شد .

در این جلسه متهم و وكیل وی به دفاع از خود پرداختند.

در هفتمین جلسه دادگاه نیز كیفرخواست چهار متهم زن پرونده فساد بزرگ مالی قرائت شد .

نماینده دادستان، شركت در اخلال در نظام اقتصادی كشور از طریق همكاری با شبكه فساد بانكی در قالب شبكه یا باند سازمان یافته برای ارتكاب جرایم نظیر جعل، ارتشا، كلاهبرداری و معاونت در تحصیل مال نامشروع به نفع گروه امیر منصور آریا را نخستین اتهام خانم 'ج.الف' خزانه دار گروه آریا عنوان كرد.

'رضا نجفی'، معاونت در پولشویی عواید حاصل از جرم، از طریق تسهیل وقوع بزه موضوعات گشایش اعتبارات اسنادی را دومین اتهام ج.الف عنوان كرد.

نجفی اضافه كرد: به گفته 'ج.الف'، خانم 'ع.ح' اطلاعات كاملی از تمام شركت های گروه امیر منصور آریا داشت.

به گفته نماینده دادستان، خانم 'ع.ح' روزانه با 'م.الف' و 'الف.ش' جلساتی را برگزار می كرد و تمام قراردادهای خریدهای خارجی را وی انجام می داد.

در این جلسه علاوه بر رسیدگی به اتهامات سه متهم زن كه در دادگاه حضور داشتند، به اتهامات یكی دیگر از آنان كه با مجوز پزشكی در جلسه دادگاه حضور نداشت، رسیدگی شد.

متهمان زن حاضر در این جلسه به دفاع از خود پرداختند و خود را فقط یك كارمند ساده كه دستورات مدیرعامل را انجام می دادند، عنوان كردند .

هشتمین جلسه محاكمه متهمان پرونده فساد بزرگ مالی، 10 اردیبهشت ماه جاری با حضور چهار متهم و دو مطلع در شعبه اول دادگاه انقلاب اسلامی تهران برگزار شد.

در این جلسه آخرین دفاعیات سه نفر از متهمان به نام های ' م.الف' معاون سابق وزیر راه و ترابری، ' ا.گ' مدیر عامل شركت خط و ابینه راه آهن و 'ع.ر' سرپرست سابق حوزه ششم بانك صادرات خوزستان اخذ شد.

' ط.ن' دیگر متهم حاضر در جلسه هشتم بود كه به دلیل مفتوح بودن پرونده اش در دادسرا، اخذ آخرین دفاعیات وی به جلسات بعدی موكل شد.

قاضی ' ناصر سراج' سه شنبه گذشته در گفت و گو با خبرنگار اجتماعی ایرنا اعلام كرد: در نهمین جلسه محاكمه متهمان پرونده فساد بزرگ مالی، به اتهام هفت نفر دیگر از متهمان این پرونده رسیدگی خواهد شد.
