به گزارش ایرنا از پایگاه اطلاع رسانی دولت، قانون موافقتنامه بین ایران و آفریقای جنوبی در مورد كمك متقابل بین گمركات آنها كه در مجلس شورای اسلامی تصویب و به تأیید شورای نگهبان رسیده است، از سوی رییس جمهوری برای اجرا ابلاغ شد.

بر اساس این قانون، هر یك از طرفین از طریق گمركات خود و طبق مقررات مذكور در موافقتنامه درباره وصول مطالبات گمركی به یكدیگر كمك خواهند كرد و در راستای پیشگیری، تحقق و جلوگیری از تخلفات گمركی قدم برمی دارند.

طرفین از طریق گمركات خود و طبق مقررات مذكور در این موافقتنامه به منظور حصول اطمینان از اینكه قانون گمركی مربوط به آنها به طور صحیح رعایت شده است و در راستای پیشگیری، تحقق و جلوگیری از تخلفات گمركی به یكدیگر كمك متقابل ارائه خواهند كرد.

همچنین كمك در چارچوب موافقتنامه طبق مقررات قانونی و اداری داخلی طرف درخواست شونده و در حدود صلاحیت و منابع در دسترس گمرك صورت خواهد گرفت.

بر اساس این قانون، هر گمرك طبق درخواست یا ابتكار خود تمام اطلاعات موجود را كه به حصول اطمینان از اجرای صحیح قانون گمركی و جلوگیری، تحقیق و مبارزه با تخلفات گمركی كمك می كند، برای گمرك دیگر فراهم خواهد كرد.

گمرك درخواست شونده، بنا به درخواست، تمام اطلاعات مربوط به قانون و تشریفات گمركی خود و مرتبط با بررسی های مربوط به تخلف گمركی را ارائه خواهد كرد.

همچنین هر یك از گمركات از اطلاعات مربوط به تشریفات كاری خود جهت ارتقای فهم و درك خود از روش ها و تشریفات یكدیگر به صورت اشتراكی با گمرك دیگر استفاده خواهد كرد.

بر این اساس، گمركات در خصوص وصول مطالبات گمرگی به یكدیگر كمك خواهند كرد، مشروط بر این كه هر دو طرف در زمان درخواست، مقررات قانونی و اداری لازم را وضع كرده باشند.

*** نظارت بر اشخاص، كالاها، اماكن و وسائل نقلیه

بر این اساس، هریك از گمركات به ابتكار خود یا بنا به درخواست كتبی گمرك دیگر به موجب شرایط قانون داخلی و طبق رویه های اداری خود نظارت ویژه ای بر فعالیت و بویژه ورود و خروج اشخاصی كه مظنون به نقض قوانین گمركی طرف درخواست كننده، بطور اتفاقی یا معمول هستند از قلمرو خود؛ جابجایی یا انبار كردن كالا و اسناد پرداخت كه بنا به اعلام گمرك درخواست كننده در مظان داد و ستد عمده غیر قانونی در قلمرو آن طرف هستند، خواهد داشت.

همچنین اماكن مورد استفاده برای انبار كردن كالاهایی كه ممكن است در ارتباط با داد وستد عمده غیر قانونی در قلمرو طرف درخواست كننده مورد استفاده قرار گیرند و وسایل نقلیه ای كه مظنون به استفاده در نقض قانون تخلفات گمركی در قلمرو طرف درخواست كننده هستند، مورد نظارت قرار می گیرند.

بر اساس این قانون، گمركات طرف ها، در محدوده قانون داخلی هر طرف، در صورت لزوم در شرایط تحویل كنترل شده بین المللی مواد مخدر، مواد روانگردان و موادی كه غالبا در ساخت غیر قانونی مواد مخدر و مواد روانگردان مورد استفاده قرار می گیرند، برای كشف تخلفات مربوط به كالای مزبور و شناسایی اشخاص مرتكب چنین تخلفاتی با یكدیگر همكاری خواهند كرد.

*** بازدیدهای ماموران ویژه

ماموران ویژه ای كه توسط گمرك در خواست كننده تعیین شده اند، می توانند بنا به درخواست كتبی و با اجازه گمرك درخواست شونده و با رعایت شرایط آن گمرك، به منظور تحقیق در مورد تخلف گمركی، در دفاتر گمرك طرف درخواست شونده، اسناد، دفاتر ثبت و سایر داده های مربوط را برای بدست آوردن هر گونه اطلاعات در مورد تخلف گمركی بررسی كنند، از اسناد، دفاتر ثبت و سایر داده های مربوط در ارتباط با آن تخلف گمركی نسخه برداری كنند و در جریان تحقیقاتی كه توسط گمرك درخواست شونده در ارتباط با گمرك درخواست كننده انجام می شود، حضور داشته باشند.

بر این اساس، هر گونه اطلاعاتی كه به موجب این موافقتنامه دریافت می شود صرفا برای اهداف این موافقتنامه و توسط گمرك مورد استفاده قرار خواهد گرفت، جز در مواردی كه گمرك ارائه دهنده چنین اطلاعاتی، استفاده از آن را برای اهداف دیگر یا توسط مقامات دیگر تجویز كرده باشد.

همچنین، گمرك طرف دریافت كننده مطابق با اهداف و در حیطه شمول این موافقتنامه، می تواند از مدارك و اطلاعاتی كه طبق این موافقت نامه كسب كرده، در سوابق مدارك، گزارشات، شهادت نامه ها و در جریانات دادرسی و اتهاماتی كه در دادگاه ها مطرح می شود، به عنوان مدرك استفاده كند.

*** معافیت از تعهد ارائه كمك

بر اساس این قانون ، در مواردی كه به نظر گمرك درخواست شونده كمك درخواستی ممكن است لطمه به حاكمیت، امنیت، سیاست عمومی یا سایر منافع اساسی آن طرف وارد كند یا باعث افشای اسرار صنعتی، تجاری یا حرفه ای شود یا با مقررات اداری و قانون داخلی آن تناقص پیدا كند، می تواند از ارائه كمك خودداری كند یا ارائه آن را موكول به تحقق برخی شرایط كند.

*** اصول اساسی برای حفاظت داده ها

داده های شخصی تنها در صورتی قابل انتقال هستند كه سطح حفاظت شخصی فراهم شده توسط قوانین طرف ها، برابر باشد و طرف ها باید حداقل حفاظت و حمایت را بر اساس اصول مندرج در این ماده تضمین كنند.

بر اساس این قانون ، طرف ها از مجاری دیپلماتیك به طور كتبی یكدیگر را از انجام الزامات قانون اساسی یا داخلی برای لازم الاجراء شدن این موافقت نامه مطلع خواهند كرد. این موافقتنامه در اولین روز ماه دوم پس از تاریخ دریافت اطلاعیه موخر تر لازم الاجراء خواهد شد.

مدت این موافقتنامه نامحدود است اما هر یك از طرف ها می توانند با ارائه اطلاعیه كتبی در هر زمان از طریق مجاری دیپلماتیك موافقتنامه را فسخ كنند.

اعتبار این موافقتنامه سه ماه پس از تاریخ اطلاعیه مزبور خاتمه خواهد یافت و با این وجود اقدامات جاری در زمان فسخ طبق مفاد این موافقتنامه تكمیل خواهد شد.

همچنین، گمركات به منظور بازنگری این موافقتنامه بنا به درخواست یا در پایان 5 سال از تاریخ لازم الاجراء شدن آن با یكدیگر ملاقات خواهند كرد، مگر آنكه عدم نیاز به بازنگری را به اطلاع یكدیگر برسانند.
